1. Acceptance of Terms

By accessing or using Logomate ("the Platform"), you agree to be bound by these legally binding Terms of Use ("Terms"). If you do not agree to these Terms, please do not access or use our services. Your continued use of the Platform constitutes acceptance of any updates to these Terms.

2. Account Responsibilities

You must provide accurate, complete, and up-to-date information when creating an account.
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
You agree to notify us immediately at eureka@ailogogenerator.sh of any unauthorized use of your account.
You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to use this Platform.

3. Intellectual Property

Your Content:

You retain full ownership of any images or text you upload to the Platform. By submitting content, you grant Logomate a limited, non-exclusive, royalty-free license solely to process your content for the purpose of logo generation.

AI-Generated Logos:

Upon full payment, you receive exclusive commercial rights to the logos created for you using our Platform. You may not resell, sublicense, or redistribute our underlying design templates, AI models, or algorithms.

Our Ownership:

Logomate retains all rights, title, and interest in and to all software, templates, algorithms, website content, and platform infrastructure. Nothing in these Terms transfers any ownership rights of our intellectual property to you.

4. Prohibited Uses

You agree that you will not use the Platform to:

Generate, create, upload, transmit, or distribute any NSFW (Not Safe For Work), sexually explicit, pornographic, adult, or obscene content of any kind. This prohibition applies to all inputs (text prompts, uploaded images) and intended outputs.
Generate content that promotes, glorifies, or facilitates violence, terrorism, self-harm, or hate speech targeting individuals or groups based on race, ethnicity, gender, religion, sexual orientation, or disability.
Create logos or content intended for illegal, defamatory, fraudulent, or infringing purposes.
Violate any applicable local, national, or international laws or regulations.
Reverse-engineer, decompile, scrape, or otherwise attempt to extract source code or data from our Platform.
Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
Infringe upon the intellectual property rights, privacy rights, or other rights of any third party.
Use automated tools, bots, or scripts to access or interact with the Platform without our express written permission.

Violation of these prohibitions may result in immediate account termination and may be reported to relevant law enforcement or regulatory authorities.

5. Content Moderation

Logomate employs automated moderation systems to screen user inputs prior to AI content generation. These systems are designed to detect and block attempts to generate prohibited content as described in Section 4. By using the Platform, you acknowledge and consent to this screening process. Logomate reserves the right to reject, remove, or report any content that violates these Terms.

6. Payments & Refunds

All subscription and one-time fees are non-refundable except where required by applicable law.
We reserve the right to modify our pricing at any time, with at least 30 days' advance notice provided via email or platform notification.
In the event of account termination due to a violation of these Terms, no refunds will be issued for any unused portion of a subscription.

7. Termination

Logomate reserves the right to suspend or permanently terminate your account at our sole discretion, including but not limited to cases of:

Violation of any provision of these Terms
Generation or attempted generation of prohibited content
Prolonged inactivity
Fraudulent or abusive behavior

You may delete your account at any time by contacting us at eureka@ailogogenerator.sh. Termination does not affect any rights or obligations that arose prior to the termination date.

8. Disclaimers

Logos and all platform outputs are provided "as is" without warranties of any kind, express or implied.

We do not guarantee the uniqueness, originality, or legal compliance of generated logos, including but not limited to trademark clearance or copyright status.

We are not liable for any indirect, incidental, consequential, or punitive damages, including loss of profits, data, or business opportunities arising from your use of the Platform.

Our total liability to you for any claim arising out of or related to these Terms or the Platform shall not exceed the amount you paid us in the three (3) months preceding the claim.

9. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your information as described therein.

10. Changes to Terms

We reserve the right to update or modify these Terms at any time. We will provide notice of material changes via email or a prominent notice on the Platform. Your continued use of the Platform after such notice constitutes your acceptance of the revised Terms.

11. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Denver, Colorado.
